She was thrown from the motorcycle and pronounced dead at the scene. After the crash, Nerio was hospitalized with serious injuries and reportedly told investigators he was hit by an unidentified vehicle. However, an arrest report cited by KSAT noted no signs of rear damage to the bike that would indicate such a collision.

Nerio had previously claimed to police that he was sideswiped by a large red truck or SUV. Yet, upon reviewing dash cam footage from the motorcycle, investigators determined that an "illegal maneuver" by Nerio led to a collision with a red tow truck. This evidence contradicts his earlier statement about the accident's cause, according to an arrest warrant affidavit.

Further complicating Nerio's account, toxicology reports showed the presence of not only alcohol but also cocaine, cannabinoid, and fentanyl in his system at the time of the crash. This points to a significant impairment that likely contributed to the tragic outcome, as per the affidavit obtained by both Fox San Antonio and KSAT. Nerio, charged with intoxication manslaughter, is currently booked in the Bexar County Jail with his bail set at $150,000.
